So for a few years I've been posting music to my soundcloud account,
mostly extreme metal I write for two solo artist of mine. As of late, a
theme has popped into my lyrics, a not-so-clean theme that I don't
normally write about, wanking. But since I am massively pro-wanking(tm) I
decided to write 2 songs about it. So I uploaded one, not realizing,
that soundcloud's terms of service say you can't do that, your content
cannot be sexually explicit.... WTF! Here is the exact text from the
terms and services section:
"Representations and Warranties
You hereby represent and warrant to SoundCloud as follows:
(i) Your Content, and each and every part thereof, is an original
work by you, or you have obtained all rights, licences, consents and
permissions necessary in order to use, and (if and where relevant) to
authorise SoundCloud to use, Your Content pursuant to these Terms of
Use, including, without limitation, the right to upload, reproduce,
store, transmit, distribute, share, publicly display, publicly perform,
make available and otherwise communicate to the public Your Content, and
each and every part thereof, on, through or via the Website, any and
all Services and any Linked Services.
(ii) Your Content and the availability thereof on the Platform does
not and will not infringe or violate the rights of any third party,
including, without limitation, any intellectual property rights,
performers’ rights, rights of privacy or publicity, or rights in
confidential information.
(iii) You have obtained any and all necessary consents, permissions
and/or releases from any and all persons appearing in Your Content in
order to include their name, voice, performance or likeness in Your
Content and to publish the same on the Platform and via any Linked
Services.

defamatory, obscene, racist, sexually explicit, ethnically or
culturally offensive, indecent, will not promote violence, terrorism, or

(v) Your Content does not and will not create any liability on the
part of SoundCloud, its subsidiaries, affiliates, successors, and
assigns, and their respective employees, agents, directors, officers
and/or shareholders.
SoundCloud reserves the right to remove Your Content, suspend or
terminate your access to the Platform and/or pursue all legal remedies
if we believe that any of Your Content breaches any of the foregoing
representations or warranties, or otherwise infringes another person's
rights or violates any law, rule or regulation."
Look at part 4 above:

So basically they are not allowing people to upload merely offensive content of any kind. Define offensive? Some lyrics I write might offend the idiots out there? In fact you can say that any content can be offensive, because there will always be someone who will find it offensive.
Notice
that it also outlaws "culturally offensive content". WTF! Define
culturally offensive. That is a complete subjective statement. Someone
can find a song's lyrics about zombies eating babies to be offensive or
"culturally offensive". It's stupid, vague and idiotic that that,
sexually explicit, obscene and indecent content are not allowed......
They are vague, subjective content definitions that all require the
person 'offended' by them to find them offensive for it to be any of
those..... Not objective. Is our country and our Internet such a nanny
state now that offensive content has to be gotten rid of... For the
children? WTF!
Also, what the fuck is the
problem with sexually explicit content? Both youtube and Soundcloud
block this stuff and it's completely normal and natural. Yet in this
world it's horribly offensive to even mention any kind of sexual
content in lyrics. It's like 'all mentions of sex = bad for a children's
mind so we need to get rid of it'. It's stupid.
It's
really lucky of me to upload the music lyrics I do which can fit into
some of these categories and not be deleted yet. I have had some
suspicious problems with my soundcloud accounts in the past so maybe. I
wish soundcloud would get rid of the 'offensive','abusive','culturally
offensive','obscene',and 'indecent' clauses. It isn't needed. People
offended by lyrics can put them in categories like this to get them
taken down and that is NOT the way the Internet should work.
I'm not happy about this. This crap should not be on the Internet at all. Subjective content restrictions need to be Gotten rid of, completely.
They don't do anything positive. They just prevent people from being
offended. It's like accidentally or purposely offending people is a
crime now. It shouldn't be. Guess what folks.... you have the right to be offended. You have no right whatsoever to be shielded from offensive content because that's fucking stupid. End of story.

NSA's new Malware plan must be stopped
So NSA's rediculous power is only going to get worse now. If you thought them collecting info was bad, well, guess again. Now, according to Slashdot, they want to use Malware, probably rootkitted malware to steal info from possible "terrorists", using fake emails spread claiming to be from Facebook and other Social Networking services. It's bad enough when we have no privacy anymore, but now they want to mess up the security of our computers? What the hell is wrong with them. Do they even know how bad malware is? Certain malware can totally fuck up a system, and that's what they want to do to get their spying data from us.... It's really sick...
I highly recommend that people who don't want their PC's hacked by NSA and others (because others will use the malware the NSA makes against other people, mark my words) should contact their Representatives and complain. It's really important we do this. Send them a message saying how you don't want the government allowing others to utterly destroying people's PC's (because that's what malware does) while the NSA can do the same thing at the same time! Tell them how disgusted you are at the NSA! Show them your anger! Remind them that what NSA is planning to do should be punished with Life in Prison like it would be for any Civilian hacking a PC. But NSA won't pay thay price, will they?
Some hacker nuked my PC 2 years ago and 2 1/2 years before that. I've been a victim of nasty malware, Rootkits, Polymorphic file infecting Viruses that nuke your PC by infecting all programs on your computer, destroying all your date (like Virut), and worse. This shit is already out of control, and the companies that makes pile of shit antivirus products aren't doing shit against the horrible malware out there, and now the NSA wants to join the hackers in the great job of nuking our PC's for what, for National Security? WTF!
This whole pile of crap idea is NOT for national security. It's for spying on people and accessing their PC to enable them to use that whole framework to enforce laws that are impossible now, like Punishing people for playing violent games (through a tax or prison time even), or listening to mp3 music (getting their info for mass lawsuit filing!, or worse), or to punish people who criticize the government. This crap is NOT needed for National Security! Tell your REP that!
In the mean time, It's really important to Protect your Own PC. An antivirus will do nothing against their malware. It will be a rootkit more than likely and Antivirus products can't even flush out tougher virii or fake antivirus crap now. Instead get the free Program Sandboxie. GOP trying to overtax "Violent gaming companies" with the new Tax Reform bill.
So reading gamepolitics got me this article to attack. Basically, the GOP is trying to make it so R&D tax credit does not get given to "Violent Gaming Companies", another ill planned attempt to kill off the industry in 5-10 years, like the Oklahoma Tax Bill that would have made it legal to tax people who stored, played, and otherwise consumed violent games 1% Of all the property they bought in the state, (which would be 100's of dollars per storage, use, etc for me, more for others). Since no one could afford such a tax no one would even buy violent games and the industry would go bankrupt, provided the bill spread to other states like the filthy virus it was. Good thing it was struck down in court.
But the current Tax Reform bill has absolutely nothing to do with tax reform in a positive way when you factor in the future consequences the industry will have. I have no clue how high the current Tax Credit is for R and D for the gaming industry but it must be quite significant. Make it so this tax credit goes out the window and gaming companies will eventually (not right away but eventually) stop even trying to make new engines for their games because they can't afford it. So they use old engines, and since old engines = shit graphics to most of the gaming community, the game will get shitty reviews and won't even sell. Once this happens to 75 percent or more of the industry you have only the big corporations even being able to afford the tax credit and all others use old engines and eventually the new games with the old engines get panned as obsolete and they don't make anymore money off of them, therefore they go out of business because they can't afford to make new engines for their games.
I for one hate this. It's not entirely the GOP's fault, because to me Graphics =/= better game, Gameplay is far more important and so is story. But to modern consolitis infected morons graphics are everything and because of that this whole idea will eventually kill the industry. Someone has to stop this kind of thing now, because I don't see the trend of better graphics = better game changing soon.

Denverpost.com 1999 death threats and the coverup Revealed.
So I told you in an old post how my anti-video game censorship crusade began. I was brutally threatened by an Internet troll on a denverpost message board after rudely responding to him after he did the same to me after I posted how I hated how denverpost and other news sites were making up utter BS about Doom's fake connection to columbine. It's a long story but what isn't is there culpability in allowing someone to threaten my life and how nothing has been done about it since.
The troll swore, used sick sexual innuendo, threatened violence AND rape to anyone who said something trying to defend violent games on the forum. And for 3 months the troll was allowed to do that, threaten to crack my skull in and much worse. The final post involved the troll saying "I have enough evidence to prove gamers get violent" or something like that, something very lawyer like. It was almost like the troll was a lawyer and was trying to get evidence that gamers are violent through a warped method of insulting gamers constantly till they eventually would threaten him back and writing down the responses. I have no proof this troll was a lawyer, except for this and 1 other thing, the persons email address was justicemail.com, email for the law community.
Eventually the site was shut down, the entire forum service actually, and the entire email service was also shut down. The account for justicemail.com that this person used does not exist and this image taken with my web browser proves it.
It seems this whole thing was being covered up. First the post that said "I have enough evidence" was taken down suddenly, no more than 20 minutes later. Then the entire forum service goes down and the email service too? Too weird to be a coincidence to me. But what really proves this is that actual evidence that proves the identity of this troll (probably a fake identity) was found by me recently, and it was taken down too!
For years I have been using reverse email lookups to find the Identity of the troll who threatened me. Almost all of them were scams and the ones that weren't gave me no matches. I kept looking for more for 12 years or so and until this year I didn't find any clue who this idiot troll was. I tried spokeo.com and It gave me a match to a person in San Diego but nothing else. That was a start... But the more I tried the more I failed to find out more. Dozens of google searches of the email led to nothing, I was hoping to find an account of the troll threatening gamers on some other message board lazy enough to use the same email but no such luck. Until this year. Google searching "kissle@justicemail.com" lead me to this result which I took a screenshot of because I was afraid it would be taken down:
So the troll in question was "Mike Pope" from Thailand? Somehow I think this is a pseudonym because Mike Pope doesn't sound like a name from a person living in Thailand to me. It sounds fake. It's besides the point because this result was taken down by google mysteriously. Another cover up? I don't know but if you google "kissle@justicemail.com" you don't get this result anymore. It's a coverup, I tell you.

Do something about the TPP, fellow youtubers ..... Mail your senators now.....
Well Folks. The TPP (trans pacific partnership) is still being worked on. This draconian "treaty" to force copyright infringement laws, very draconian ones, ones that make SOPA look nice, has to be stopped. It's up to you to stop this. Because under this Treaty, YouTube and all of the Internet gets shut down. Including Gaming sites. This treaty would do the following:

assurance that the site contains lots of infringing links. Also temporary copy infringement, is
not exempt to this. Every time someone watches a video on YouTube, 1000's of temporary
copies are created by the streaming process. The ISP would be forced to use deep packet
inspection to find these and if one of these temporary copies is a YouTube packet that is part
of a youtube video stream that has one "alleged" infringement on it, the person watching the
video could get arrested, and sued, because the ISP is forced to tell the "alleged" copyright
holder. The most recent RIAA case defendant had to pay $22,500 dollars per songs for
illegally downloading only 30 songs, each only 99 cents each... Imagine that multiplied by
1000 for listening to a video on YouTube where video game footage is overlayed with
copyrighted music, because of the 1000's of temporary copies produced on the persons
HDD, all caught by the ISP. That's $22,500,000 dollars for watching a video!
Under this, there is an almost certain chance YouTube will be shut down. Youtube is filled with
infringing videos uploading copyrighted music. At least a few million. But the other video types
uploaded to youtube, such as video game lets plays, walkthroughs, etc, could all be sources of
"alleged" infringement, due to the fact that many videos showing off games are put under fair
use, which TPP seems to be made to eliminate. But even worse, since the government simply
has to say a site is filled with infringing links, a lot of sites will be targeted under this. Expect all
the big file sharing hosts like 4shared, mediafire, etc to be shut down first. They have tons of
copyrighted material on them, and many people keep assuming they profit off pirated files
because they allow people to buy premium accounts for more upload space, even though the
pirated files are all tiny files, all tiny portions of an archive, split into 200 parts with 200 accounts
registered to upload a file. There is no way sites like this are profiting off of files uploaded to
their free account due to the fact that ads on these sites are part of every download, no
matter how legal."
It's important to talk to your senators NOW. Let them hear your voice. Tell them you can't
stand what this treaty is doing and that that your against it, and they should not vote for it.
It will shut down 90% of the known internet. This is really important, you can do something
about this... It is due for ratification soon, by the end of the year.... Get to work, youtubers!

to force your browser (FireFox Only) to use the Encrypted HTTPS format. This should (in theory)
prevent the ISP's from illegally reading your traffic (deep packet filtering) under the TPP to find
alleged copyright material some 2 bit fake copyright holder claims you are distributing when your
not. These things can be bypassed. In case this gets passed make sure to do this!

Assholes from Connecticu(n)t won't let the Violent Video Games BS Lis Die down after Sandy Hook,,,,,
After checking Gamepolitics.com, like I do multiple times a day, I came across this link from a shoutbox post, talking about a sandy hook recreation game and the nonsense the public figures in Conneticu(n)t are saying about it. The article linked is viewable here. Some of this crap is really not needed now and I am here to trash it like it deserves to be.

So now a violent game caused sandy hook? What the hell does this writer think he is, a nonbiased source? It seems very likely that this guy is an anti-gamer and wants to make games look bad. So he posts a piece where he says that it is not an opinion, but a fact that Sandy hook was caused by video game violence, that's right, Caused, not contributed. To him there are no factors. It's all Mass Effects fault, with all of it's nonexistent child rape scenes FAUX news tried to claim it had. Sure....

MA tries to start another violent game Witchhunt!!!
Well it seems the idiots attacking violent games never stop, do they? On the heels of the idiotic study into so called violent games "effects" on kids set up by Senator Jay Rockefeller, We have my state trying to start the same old nonsense again. A politician in MA has decided that it would be a good
idea to start a biased study to study the effect of games on kids again.... Right after MA stalled their bill aiming to restrict violent games so they could not be bought by adults. These "studies" popping up everywhere get to me. Because just like all of the other game attacking studies, these
are bound to be biased, and engineered to show a certain result. A lot of other studies are funded by the Center for Successful parenting, a group that has this in their mission statement "We aim to motivate leaders of <insert tons of industries here> to change culture so violence is not shown to
children" basically meaning "ban violent games", because changing the culture of violence can only done by removing the violence.
The current studies by Rockefeller and this idiot in MA are troubling. The Rockefeller study, has language in it's text that tells that the studies can find whatever results they want, because it asks if the violent games have any "new" effects on kids. After the brief but stupid moral panic
surrounding child molestation and it's nonexistent link to violent game playing, spurred by that
Preacher Boykin and Ralph Nader, I wondered if they could use the vague language in the study to find that violent game playing leads to child molestation and pedophilia. To see what the Study in MA does I looked at the text of the study closely...

"That a special commission is hereby established for the purposes of making an investigation and study relative to video games as a form of media and as a training tool. Within that context, the commission will focus upon video games that allow the player to simulate severe battery or killing (“killing games”). So this study wants to see if games are an effective training tool. We've been told BS in the newspapers from the hack psychologists that violent games are being used in the military to break down the inhibition to kill. But this blog, written by a military trained
soldier debunks the whole thing. I quote:

Video games, or things resembling games, are being used in some areas of the military.
During training ops higher ups often pit virtual countries against each other, but these are basically pushing pieces, simulating battles and using the troops to set up comm architectures and run test flights.
Some first-person-shooters are used by infantry troops to plan out tactics - but these are mostly for higher-level planners; Games will never, ever take the place of constant, demanding, mind-numbing repetition. Proper execution of maneuvers rely on muscle memory; Drill, in boot camp,
forms the introduction to this doctrine.
Rainbow Six may let you breach and clear, but this doesn't translate to the motions or related actions: Which direction do you break? What targets are you responsible for? Who can declare a room 'all clear'? Did you check your overhead?
Flight simulators seem like video games, though I'm sure those responsible for both maintaining and operating them see them more as necessary steps to save billions of dollars worth of equipment from inexperienced hands.

and forced violent images day in and day out and brought them to the level of an infant and replaced their language with one of your own devising and had them progress their violence on increasingly complex organisms -- THEN, and only then, would I be willing to entertain that the media was

The fact that the studies author is bringing this nonsense claim up to the Government is proof that the the government is trying to ban violent games again, IMHO. It must be stopped before it gets to the 90 day phase (see below), or we could have a MA ban on violent games to adults. Not to kids.

At least one of the people involved has a bias against violent games if I am right. They mention "a member of the military who specializes in military training". This fits one of the Hack Psychologist to a tee. Another Hack Psychologist could be in it too if I am right, "1 constitutional lawyer who specializes in freedom of speech" sounds a lot like a retired anti-game activist everyone
in the community hates to me. They also mention how they need to study the impact of the proposed regulation on free speech, probably as a cheap way to see how they can make a constitutional law that causes violent games to not get in the hands of adults, such as the Oklahoma tax on 1% of all property every time someone in OK played, stored, bought and otherwise consumed violent games.
They also want to study how violent games have caused mass killings like columbine (I assume). Whats to stop them from not believing the nonsense spread by the idiots in the government, the media, and unknown parties that says violent games influenced Harris/Klebold/
Lanza, etc? Such things include the Doom will become reality hoax and similar "tidbits of information" that seem to make it look like mass killers played violent games but this info is badly written at the least, and is outright lies at the worse.

I find it disgusting that the government would spend millions of tax dollar money on a bill that would
have restricted violent games to minors so adults could not buy them. There is no reason to study
the false connections between violent games and Real life killings, all invented by the media and anti-gaming groups. The hoax mentioned above was used as "evidence" against the industry in an Anti-Gaming Group's Amicus Brief. This group is from the Midwest, they are called the Eagle Forum, and they are pro-religious zealots who think violent games should be banned to adults and gamers should all be dealt with somehow. They were trying to fool the Justices in the SCOTUS to think this evidence is real and not a hoax. One of the people championing the break down to kill "theory" is a zealot former lawyer who once said on the gamepolitics forums that all gamers need to get the Death Penalty. If you plan to study these things, you must be sure NOT to be swayed by these types. For they tried to sway the EMA vs BROWN Case and others.....
